Terms & Conditions of Membership

1. Introduction:

Thank you for choosing Premier Boxing Club as your preferred destination for your continued good health, fitness and general well-being. Please read through these Terms and Conditions of Membership (“Terms and Conditions”) carefully. To become a member of Premier Boxing Club (“the Gym”) and to enjoy the use of our facilities, products and services, you must agree to be bound by them. Premier Boxing Club and is located at 4/140 Military Road, Neutral Bay, New South Wales, 2089 (“the premises”).

You acknowledge that the nature and effect of all our terms and condition have been now or previously drawn specifically to your attention; that you have had adequate opportunity to read and fully understand such terms and conditions, as well as all the Terms and Conditions of this agreement; and you understand and agree that, by signing up as a member of our Gym, you are bound by the terms of each and every clause of this agreement.

As a member of Premier Boxing Club, you can use our club in line with these terms and conditions, including the club code.You understand and agree that your use of our club must be in accordance with these Terms of Service and we may deny, suspend, restrict or terminate your service or membership wihout prior notice if you fail to comply with them.
Photography, video or audio recording of our classes is prohibited without the express written permission of Premier Boxing Club.
All our fees are non-refundable, non-transferrable and are subject to regular review.

2. Membership:

From the date of completing this document, and thereby formalising the membership process, you will become entitled to receive the services and products offered by the Gym. Some services and products may incur additional costs or fees.

The gym may, in its absolute discretion modify or amend these Terms, hours of operation, services offered, and fees charged, and such modifications will be binding upon you once displayed on this Website. You should regularly check these Terms on the Website for changes. Details of the Club’s current opening hours and facilities are displayed in the Club and on this website. We may sometimes need to change opening hours or facilities available. If we need to do this we will, where reasonably possible, display notices in the Club or post them to our Website and you agree to be bound by such changes. Our Premier Boxing Club app is a free download from your app store allowing you to check your visits record, make bookings and check updated class times or instructors and closed days. References to “the gym” “the Club” “we”, “us” and/or “our” in these Terms and conditions is a reference to 7 Arts Academy Pty Ltd and its’ related entities, affiliates and franchisees (as relevant).

3. Duration:

This agreement commences on the commencement date, and continues indefinitely until such time as your membership with the Gym is terminated by either party.

4. Undertakings by you:

When you are required to provide the Gym with details and personal information, you undertake to do so, and undertake also that they will be true, accurate and complete. You accept that the details and information, which you have supplied, and will supply, to the Gym will be relied upon to provide you with the available services and products.

In addition to the Terms and Conditions in this agreement, you undertake to be bound by the privacy policy of the Gym, and any other policies or rules, which may be adopted, rescinded or amended from time to time as required.

You undertake not to use, in any circumstances, the trademarks, logos, designs, trade names, the copyright, know-how and patents relating to the Gym. If you do use any of these intellectual property rights, you will be liable for any damages, which may be suffered; and you may also be liable to criminal prosecution. You indemnify the Gym for each and every consequence flowing from your use of these intellectual property rights.

Furthermore, by signing and agreeing to these Terms and Conditions, you thereby authorise the Gym, or any of its other entities, to use any photographic images, video, or any other recording of you contained or stored on or in any such or other media, where such images were recorded whilst you are, or were, taking part in any of the Gym’s activities, using its services, or utilising any of its products. The Gym reserves the right to use these images or recordings for commercial purposes without payment.

5. No liability, Indemnity:

You acknowledge and accept that when you become a member of the Gym, and use any of its products, services, equipment, software or other facilities or services that you do so entirely at your own risk. It is your responsibility to determine whether medical clearance is required to participate in any activities or services offered by the Gym; and your failure to do so will be at your own risk, and could result in serious injury or death. It is your responsibility to notify and disclose to the Gym any matter, which may affect your training or membership, such as, but not limited to, prior head injuries, other bodily injuries or weaknesses, pregnancy or any other physical, or mental, condition, present or pre-existing, which may have an adverse effect upon your participation in any training, or the use of any equipment, products or any other services, offered by the Gym.

You agree that you shall have no claim against the Gym, its directors, employees, associates, subcontractors, agents, representatives, consultants, licensees and/or licensors for any loss, damage, harm, injury, death and/or expense, which may be suffered by you, or by any third party, resulting from any cause whatsoever, howsoever arising (excluding gross negligence), in connection with your membership and the use of any of the facilities or services of the Gym. Damages shall be deemed to include direct, indirect, general, special, incidental, punitive and consequential damages.

You assume all of the risks associated with the physical activities offered by the Gym, and assume the risk of, but not limited to, personal injury, illness, negligence, economic or property loss or damage or any kind or nature by the Gym, its owners, directors, officers, employees or agents.

In consideration of the grant of membership to you, you hereby release and discharge and indemnify the Gym from all actions, suits, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses, howsoever arising, that you may have incurred, and which in any way arise from, or in connection with, your membership and/or use of the Gym and/or its facilities and equipment, or from being on the gym premises to the fullest extent permitted by law, and whether caused or contributed to (directly or indirectly) by any other act of negligence, breach of duty or default/omission on the part of the Gym and/or its representatives owners, directors, officers, employees or agents.

Upon signing these Terms and Conditions you agree that the Gym will not be liable for any loss, damage or theft of any of your property, except when caused by gross negligence by the Gym. Further the Gym will not be liable for any death, personal injury or illness occurring on the premises, or as a result of use of facilities, equipment or services, except that it arises from the gross negligence of the Gym and/or its representative owners, directors, officers, employees or agents.

You also acknowledge and accept that the Gym has made no representations with regard to any particular competence, or with regard to the safety and/or quality of any of the equipment or services offered by the Gym in connection with your membership.

These provisions are binding on your estate, heirs, executors, administrators, parents and/or guardians.

The Gym strongly recommends that you consult your doctor before signing these Terms and Conditions, and completing the membership process, and also before commencing any exercise program or service offered by the Gym. Even though such action remains entirely in your hands, the Gym genuinely wishes your membership to result in a positive and rewarding experience.

6. Ongoing Plan/ Contracts: Debits, Freeze and Termination

The activation date of your pack/ plan is the date of your first visit regardless of the payment date.

You pay fees for ongoing memberships in advance each fortnight, by direct debit from a bank account. For a Pre-paid membership, you will pay on the day you buy it.

When your membership is due to end, you can choose to renew it before that date at your existing rate, otherwise your membership fee will be set at the current rate. By renewing your membership, you agree to the membership terms that apply at that time.

We will debit your fortnightly club fees from your nominated account on every fortnight starting the day you signed up, as set out in your membership agreement. If you use a credit card (including VISA debit facilities), we will add a 50 cent surcharge to your fortnightly debit. We reserve the right to increase your fees at any time after the minimum period of your agreement has ended. We will make a reasonable effort to tell you about this at least 1 month beforehand by emailing you, displaying a note in the club and displaying the new prices on our website and on our price lists at reception.

You can freeze your membership for 1 or more fortnights, up to a maximum of 6 fortnights each calendar. Kids Plans can be frozen during public school holidays only up to a maximum of 5 fortnights each calendar year. Each time freeze must start and end on a direct debit date and mut be announced at least 1 week prior to the next billing date. The time freeze fee for all memberships is $5 per week, which you can pay in advance or by direct debit. You can freeze your membership for up to 6 fortnights in any 12 months for travel, medical or bankruptcy reasons. However, we must be satisfied by your supporting documents, such as a a Notification of Bankruptcy from the Australian Financial Security Authority (AFSA), confirming your bankruptcy or a certificate from a medical practitioner stating that you cannot utilise any fitness services or facilities for the rest of your term because of your permanent illness of physical incapacity. If you are within your minimum term, any time freezes are not classified as a full payment toward your contract.

Cancelling after the minimum term expires

Once the minimum term of your membership expires, you or we may cancel your membership (see 3.1). When you cancel, you must pay us any fees you owe or we may take action to recover them.

You must give us one month notice to cancel, unless you are cancelling for medical reasons (with supporting evidence). We count this period from the date of your request, this means your final debit may be a pro rata amount.

To ensure your direct debit does not continue past your minimum term, you must give us notice within this term. You cannot freeze your membership payments during the notice period.

Permanent sickness or physical incapacity

You may terminate your agreement before the expiry of your Minimum term if time freeze is not suitable if:

  • You are sick or incapacitated and time freeze is not a suitable option for your circumstances. You must show us a current certificate from a qualified medical practitioner stating that you cannot utilise any fitness services or facilities for the rest of your term because of your permanent illness of physical incapacity.
  • you are bankrupt you must show us a Notification of Bankruptcy from the Australian Financial Security Authority (AFSA), confirming your bankruptcy.
  • We will not charge you an exit fee in these cases. Otherwise, we will charge an exit fee as per the amounts below based on how much of your agreement remains, or the remaining amount payable on your membership whichever is lesser :
  • up to 6 months = $295; 6×12 months = $395 ; 12×18 months = $495

Adults contracts/plans may be transferred under the following conditions. You can transfer your membership to another person (transferee) within the minimum term of your agreement so long as the transferee:

  • is not a current member
  • completes the new membership sign-up process and pays a transfer fee equivalent to the start-up fee
  • is eligible to take up your membership (for instance, you cannot transfer a corporate or concession membership to someone who would not qualify for that membership)
  • has not previously been banned by Mosman MAA or failed to pay membership fees.

The transfer is effective only after the transferee has completed the sign-up process.

We do not allow transfers once you have completed your minimum term. You also cannot transfer foundation, family or friends memberships. If you wish to cancel for any other reason, within your minimum term, and have more than 30 days left in your minimum term, you must pay out your agreement.

We calculate the amount you must pay by:

  • multiplying your fortnightly fee by the number of fortnights left in your minimum term deducting 5% from the total.

WARNING … Safety first!!

High intensity exercise must be approached cautiously in the beginning, a gradual ramp up of intensity is necessary to allow muscles cells to adapt to the new demands being placed on them. Failure to do so, opens the door to a life-threatening condition, known as ‘Rhabdomyolysis’. In short, the muscle cells are damaged flooding the bloodstream with toxins that can overwhelm the kidneys as they attempt to cleanse the blood, leading to potential shutdown. CrossFit can cause Rhabdomyolysis. It is important that you start at a reduced intensity. Brown urine, complete muscle weakness and/or swelling of joints are warning signs of ‘Rhabdo’. If you develop these symptoms, seek medical assistance IMMEDIATELY.

6. Membership must be purchased prior to entry to the Gym area.

7. Your membership cannot be used by any person other than yourself unless is SHAREABLE (prepaid packs).

8. If you were given access cards and your Card is lost or stolen, a replacement can be organised, after payment of a replacement fee.

9. If your membership fees are not up to date, or your membership is frozen, suspended or terminated, gym access will be denied.

10. You must inform the Gym of any change in your contact details, bank accounts, credit card details for payment, and any other details relevant to your membership.

11. You may receive marketing material by various means at any time. It is your responsibility to contact the Gym to request discontinuance of any such material.

12. On termination of your membership you must return your membership card to us, if priory given.

13. If we terminate your membership, you will no longer be eligible for membership of the Gym.

14. Being a strictly Members Only Gym, non-members are not allowed onto the premises, unless expressly permitted by management.

15. Alcohol or illegal drugs are strictly prohibited on our premises.

16. Food or drink purchased from outside the Gym is not permitted to be consumed on the premises.

17. Gym facilities cannot be used whilst under the influence of alcohol, anticoagulants, antihistamines, beta blockers, narcotics, alcohol or tranquillisers.

18. The Gym is strictly a “Non Smoking” area.

19. There will be activities or days when you may not take any photographs or video footage whilst on the premises. Should you desire photographs or video of yourself, or any other consenting member, please request assistance of the staff.

20. You will be required to pay for any loss or damage caused by you whilst in the Gym.

21. We may provide trial access to the Gym for potential members or others as specifically authorised by the Gym.

22. It is your responsibility to ensure that you correctly operate any of the Gym facilities or equipment. Use equipment for its intended purpose. Follow the instructions provided and ask for assistance if you need it.

23. No food or bags are permitted on the training floor.

24. Only drinks in plastic bottles, containing water or sports drinks purchased from the Gym are permitted on the training floor.

25. Please replace weights and other equipment after use.

26. A towel must be used on all equipment, and while on the training floor. Please wipe down equipment after use.

27. Some group exercise classes may need to be pre-booked, or may have maximum participants.

28. Timetables and instructors may change without notice.

29. If you are more than 10 minutes late for a Group Exercise Class, you may not be able to join in.

30. If an Instructor feels that a class is overcrowded, he or she may limit the number of attendees.

31. Please follow all instructions.

32. Suitable exercise gear must be worn at all times in the Gym. For example, t-shirts/tops (no bare chests) and closed footwear must be worn (unless you are in the change room/showers/locker room).

33. Lockers are available to store your belongings while using the Gym. However, the Gym shall not be responsible for theft or damage, and provides no guarantees regarding prevention of theft or damage.

34. The Gym reserves the right to open and inspect any locker suspected to contain any items prohibited under these Terms and Conditions.

35. Lockers are available for use only while you are on the Gym’s premises. Any belongings left in lockers after close of business for the day will be removed. The Gym does not assume any liability for loss of any belongings left in lockers after close of business. Any such belonging will be donated to charity if not claimed within 14 days.

36. Only one person is permitted in any shower cubicle at any one time.

37. Only personal trainers authorised by the Gym can provide personal training in our Gym. All persons undertaking the provision of any training must first become members of the Gym, or be specifically authorised by management of the Gym.

38. All persons on the premises must obey all instructions and directions given by the Gym management.

39. The Gym membership and other prices may vary from time to time.

40. We reserve absolute discretion when approving applications for membership of the Gym.

41. Personal information and no liability:

The Gym recognises that you wish your personal information to remain private. The Gym will not willfully disclose personally identifiable information to any third party. Notwithstanding that, you hereby authorise the Gym to
a) make your personal data available to employees of the Gym, who have a need to know such information
b) collect, collate and process your personal data
c) use your personal data for statistical, research and related purposes, and
d) provide third parties with your data, only once it has been depersonalised, so that it is not linked to you, for statistical, research and related purposes.

Whilst the Gym will take all reasonable steps to ensure and maintain the security and privacy of your personal information, you acknowledge that maintaining complete security and privacy of your personal information is not possible, and you agree that you will have no claims against the Gym in the event of a failure of security, or privacy.

Should your relationship with the Gym be terminated, it is your responsibility to advise the Gym to remove your personal information from the database.

42. Breach:
If you fail to observe or perform any of the Terms and Conditions of this agreement, then the Gym shall be entitled, if it decides to do so, to suspend immediately your entitlement to membership until such time as the breach has been remedied to the satisfaction of the Gym, or to terminate this agreement immediately. Whichever remedy the Gym may select, it may still claim damages against you, and exercise any rights against you, which it has in law. The Gym has no obligation to notify you in advance of the remedy which it may choose.

43. Cession and Delegation:
You may not cede any of your rights, or delegate any of your obligations under this agreement to any person or entity without the Gym’s consent. The Gym shall be entitled to cede, assign or delegate any of its rights and obligations under this agreement to any person or entity without your consent.

44. You acknowledge that no person or entity has made any representations (written or verbal) to induce you to enter into this agreement; and no verbal agreements have been made with, nor have any understandings been given by, the Gym other than those which may be set out in these Terms and Conditions.

45. Termination:
This agreement may be terminated only in accordance with clauses 3 and 40 above.
Upon termination you will no longer be entitled to receive any benefit from the Gym.

46. Photographic Images
Furthermore, by agreeing to these Terms and Conditions you hereby authorise Premier Boxing Club, or any of its other entities, using and photographic images, video or any other recording of you contained or stored by way of any other media, recorded whilst you are taking part in any Premier Boxing Club or Premier Boxing Club activities, services or utilising any of their products. We reserve the right to these images or recordings for commercial purposes without payment.

47. Memberships are strictly to be paid in advance.

48. All outstanding bills must be resolved before memberships are put on suspension or terminated.

49. One (1) month notice IN WRITING of active membership is required for cancellation.

50. Suspension policy:
a) An absolute minimum of two (2) weeks is required for any suspension period.
b) The maximum suspension period is (3) calendar months.
c) Memberships cannot be cancelled during suspension.

I UNDERSTAND THAT

the training involved at Premier Boxing Club and any other entity operating in conjunction with Premier Boxing Club may involve boxing, weightlifting, gymnastic movements, strenuous body weight exercises and other high exertion activities. I completely understand that I am not obligated to perform nor participate in any activity I do not wish to do. I understand that it is my right to refuse such participation at any time during my training sessions.

I understand that if I feel lightheaded, faint, dizzy, nauseated, or experience any pain or discomfort I am immediately to stop training and informer the trainer.

You must follow our club code. Please read and follow all signs and handouts that tell you what to do. If you don’t understand something, please ask for help. You are responsible for using our facilities and equipment correctly. If you are not sure how to operate any equipment, please ask our staff before you use it. Note that you will be responsible for any damage that you or your guests cause through a wilful act or negligence.

We provide lockers you can use while exercising but these are not security lockers. Please do not share with anyone the locker code you set up and do not bring valuables into the club. We do not accept responsibility for any loss or damage to your belongings while you are at the club, even if someone breaks into your locker. If you leave belongings in a locker overnight, we may remove them. We might give lost property to charity each month, including unclaimed items from lockers.

All members and guests must wear suitable clothes in the exercise areas. We do not allow clothes with offensive images or inappropriate advertising.

We can refuse entry to anyone, including members, if they act unreasonably or break the code. Entrants under 18 years are considered minors and must be accompanied by a guardian or have a guardian’s consent to participate in any of our classes or activities. We may also warn you that you risk having your membership cancelled. If you continue to behave in the same way, we may cancel your membership immediately.

We can cancel your membership without warning if you behave in a way that is risky or seriously inappropriate, such as:

  • threatening or harassing others
  • damaging equipment
  • using illegal or performance-enhancing drugs
  • instructing other members when we have not authorised you to do so.

Your responsibilities, including payment of membership fees, do not depend on how often you use a club. You must tell us about anything that affects your membership, and any changes to your contact and bank details.

You promise to:

  • make sure that you know how to exercise safely, by asking if necessary
  • use your best endeavours to exercise safely
  • not take valuables into the club, even if you plan to put them in a locker.

Saturday 9am – 10am

A fast pace fun class with lots of oohing and arring to much for the boys to handle, there will be lots punching, lots of abs and core, plenty of legs, bums and loads of shoulders.
